Sounds like extortion to me; having to pay a fine so they don�t sue you.  
That is the kind of behavior we punish schoolyard bullies for.  (gimmee your 
lunch money or I�ll stomp you)  
Don�t they think a simple cease and desist order would suffice?
I guess those don�t pay slimebag attorney retainer fees.
