Tyrone,
     If there was a police report with statements concerning the accident
you need to forward those to his insurance company in order to prove fault.
If the statements conflict, you must go to the jurisdiction of the accident
and have them issue a traffic ticket based on civilian complaint, and prove
it in court. Then you can place a claim against his insurance company. Do it
ASAP.
